TERMS AND CONDITIONS

Please read the following Terms and Conditions carefully.

PROFIMAR is a brand which belongs to Profi Igpa Ltd. If you visit, order or shop at PROFIMAR, you acknowledge that you accept these Terms and Conditions unconditionally. PROFIMAR reserves the right to make changes to these Terms and Conditions at any time and at its sole discretion. The Terms and Conditions, which are available on the website at the time that you visited PROFIMAR or placed your order, shall apply to any offer, order or transaction with us. It is your responsibility to check the Terms and Conditions. Unless there is evidence to the contrary, the data registered on our website constitute proof of all the transactions between PROFIMAR and its customers or clients.

You may not use PROFIMAR website or any content purchased via the website for any illegal purpose. You also agree to take all reasonable measures within your power to ensure that no person, firm or company other than an authorised user accesses or uses any part of our services/products.

You acknowledge that you might need to download and activate certain third party software in order to download, view and use any of the digital content provided via our website (e.g. Adobe Reader). You acknowledge that PROFIMAR has no responsibility over such third party software or their licence terms.

Pricing, Payments, Orders and Refund Policy

The prices for reports and services quoted on our website do not include VAT, any sales tax or delivery cost. You will find the total cost of your order, with price, VAT (where applicable) and delivery, in your ‘Shopping Cart’ before you submit your order. All orders will be invoiced and paid in US Dollars (USD). PROFIMAR reserves the right to modify its prices at any time. The new prices will apply to all new orders or offers. PROFIMAR will send its confirmation of the recorded order by e-mail. PROFIMAR sends invoices to you by e-mail to the e-mail address you provided, and also, on your separate request, by post.

PROFIMAR currently accepts payment by credit card. Your payments will be safe, since we use SSL secured website and officially endorsed payment gateway(s), such as PayU. You confirm that the credit card you use to make payment to PROFIMAR is yours. PROFIMAR takes payment from your credit card once you have entered your payment details and clicked the ‘Submit your order’ button. In the case where we are unable to supply the content you have ordered, we will let you know as soon as possible. In such event, PROFIMAR will give you a full refund if payment has already been taken.

PROFIMAR reserves the right to cancel or refuse any order in the event of a problem relating to the order received, including, among others, in the event of refusal to accept payment by the payment platform used by PROFIMAR. In such a case, an e-mail will be sent to the customer. PROFIMAR will not be responsible for any delay or failure to comply with our obligations under our contract with you where such delay or failure arises from any cause which is beyond its reasonable control. PROFIMAR is not responsible for any obligation of diligence in the on-line sales process. It may not be held liable for any damage arising from the use of the Internet network such as loss of data, intrusion, virus, breakdown of service, or other problems outside its control. PROFIMAR will not be held liable in the event of non-fulfilment of the contract through force majeure, interruption, total or partial strike of the communications media, fire or flooding.

Due to the nature of the products/services sold, we are unable to offer refunds or accept returns.

If a report is defective (e.g. the file is corrupted), please notify PROFIMAR via contact page or e-mail provided on our webpage. You will be entitled to have a replacement.

Intellectual Property, the Use of Purchased Material and Content

You acknowledge that all copyright, trade marks and all other intellectual property rights in our website and the content made available via the website, will at all times remain with PROFIMAR, which reserve all such rights.

Purchase of any content in digital form entitles you to use it under the following conditions. You will be entitled:

(1) to download one copy of the digital content in an available electronic format,

(2) or to obtain one copy of the digital content from PROFIMAR by e-mail, which is not uploaded to our website and delivered to you only by e-mail,

(3) to store that content in electronic format on one device,

(4) to print out a copy of that digital content for your own use.

The following limitations on usage apply:

You may not (1) offer the content for resale, (2) scan, photocopy, fax, or in any other way reproduce or copy the content, (3) share the content with anybody else, (4) distribute the content by electronic mail, over any network or otherwise, (5) upload the content to any database or server, (6) display the content on any website or intranet.

Information Sources

Information collected by PROFIMAR is obtained by our research from official statistics, official publications, internet and media search and other publicly available information. Raw data and inputs are gathered, organized, evaluated and reported by our expert staff with great care. Reports are intended for general use and do not quarantee to meet specific purposes, expectations or actions by individuals or institutions. For your spesific needs, you are advised to hire authorized and experienced experts (e.g. lawyers, customs consultants etc.).

Warranties, Disclaimer of Liability

PROFIMAR exerts every effort to ensure reliability and accuracy of information and data provided via reports, content, materials or products/services offered for sale. However, PROFIMAR makes no warranties or representations of any kind as to the operation of this site or the information, content, materials, or products/services included on this site, including also as to the fitness of the same for a particular purpose. PROFIMAR does not make any promises about the availability of the website or promise that your access to the website or its content will be delivered uninterrupted, timely or error-free. PROFIMAR disclaims any liability in connection with any technical problems you may experience with the website. PROFIMAR does not warrant that this site, or e-mail sent from PROFIMAR are free of viruses or other unwanted software. PROFIMAR will not be held resposible for any damages of any kind, including direct or indirect, economic, special, incidental, punitive, consequential arising from the use of this site. Customer information and data are used to process your order, to contact with you regarding your orders or queries, to inform you on new products, services or offers. PROFIMAR does not sell your personal information. In order to comply with a valid legal process, we may have to disclose your personal information.

Other Provisions

If any of the provisions of this Terms of Reference is deemed invalid, illegal, void, unenforceable or in conflict of the applicable law of any jurisdiction, validity of other provisions will not be affected. In the event of any dispute arising out of or in connection with these Terms and Conditions, the parties agree to exercise their best efforts to resolve the dispute as soon as possible. Any disputes or claims arising out of or in connection with the contract are governed by and construed in accordance with the laws of Turkey.

You consent to receive communications from us electronically. We will contact with you by e-mail to the e-mail address provided by you, to your postal address when necessary or by posting notices on this site.
